Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, products, and services offered by Kreative Kreationz DBA (KreativeByDesign) (“Kreative Kreationz,” “we,” “us,” or “our”). By visiting our site or purchasing from us, you agree to these Terms and our Privacy Policy and Refund/Return Policy (collectively, the “Agreement”). If you do not agree, do not use the site.

Our store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell to you.

Eligibility & Account

You represent you are the age of majority in your jurisdiction (or have parental consent) and that any information you provide is accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account.

Order Acceptance; Pricing & Availability

  • Your order is an offer to buy. We may accept or reject any order at our sole discretion, including for suspected fraud, errors in pricing/description, or unavailability.

  • If we cancel after you have been charged, we will issue a refund to your original payment method.

  • Prices, promotions, and availability are subject to change without notice.

  • We reserve the right to limit quantities per customer/household/order.

Made-to-Order Production; Processing Times

Most items are made to order. Published processing/production times are good-faith estimates only and may extend during holidays, sales, or force-majeure events. Custom/personalized items are produced from the details you submit; you are responsible for reviewing all spellings, colors, and options prior to checkout.

Shipping, Delivery & Risk of Loss

  • We ship to the address you provide at checkout. Please verify accuracy.

  • When we hand a package to the carrier (e.g., USPS/UPS/FedEx), title and risk of loss transfer to you.

  • We are not responsible for delays, misdelivery, damage, or theft after carrier acceptance or once tracking shows “Delivered.”

  • Delivery instructions, secure-location/locker delivery, signature-required, or hold-for-pickup services may be available at your request and expense.

  • Undeliverable/returned shipments caused by an incorrect or incomplete address: you are responsible for reshipping costs; if you choose to cancel instead, a 4% restocking fee may apply (see Refund Policy).

Digital Products & License

Unless expressly stated otherwise, digital items are delivered electronically and non-refundable. Subject to full payment, we grant you a limited, non-exclusive, non-transferable license for permitted personal use (or commercial use only if the product page includes a commercial license). You may not resell, share, or redistribute the files or claim them as your own.

Intellectual Property

All content, designs, artwork, logos, product mockups, text, and images on the site are owned by or licensed to Kreative Kreationz and protected by law. No license is granted except as set out in Section 5 for digital files. You may not use our IP without our prior written permission.

Prohibited Conduct

You agree not to: (a) violate any law; (b) infringe IP or privacy/publicity rights; (c) upload malware; (d) scrape, spider, or interfere with security; (e) submit false information; or (f) use the site to harass or discriminate. We may suspend or terminate access for violations.

Reviews, Comments, & Submissions

By posting or sending reviews or suggestions, you grant us a worldwide, royalty-free, sublicensable license to use, host, reproduce, and display that content for marketing and operational purposes. You warrant you own or control the rights to the content you submit.

Billing; Taxes; Chargebacks & Disputes

You authorize us (and our payment processors) to charge your selected payment method for all amounts due, including applicable taxes and shipping.
Before filing a chargeback, you agree to contact us first at help@kreativekreationz.com so we can investigate and resolve. Chargebacks filed without prior contact may be contested with order records, proofs, and carrier tracking; repeated abuse may result in account closure and refusal of future orders.

Third-Party Services & Links

We may provide access to third-party tools or links “as is” without warranties. Use of third-party services is at your own risk and governed by those providers’ terms.

Disclaimer of Warranties

To the fullest extent permitted by law, the site and all products/services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation or that defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, Kreative Kreationz will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or replacement costs, arising from or related to your use of the site or products—even if advised of the possibility.
Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim or one hundred U.S. dollars (US $100), whichever is greater. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent permitted.

Indemnification

You agree to indemnify and hold harmless Kreative Kreationz and its owners, employees, contractors, and affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your (a) breach of this Agreement, (b) violation of law or third-party rights, or (c) misuse of the site or products.

Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, carrier interruptions, epidemics, governmental actions, or utility failures).

Dispute Resolution; Arbitration; Class-Action Waiver

Please read carefully. Any dispute, claim, or controversy arising out of or relating to this Agreement or your purchase/use of our products shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

  • No class actions: You and we agree to bring claims only in your or our individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

  • Small-claims option: Either party may pursue an individual claim in small-claims court in New London County, Connecticut if eligible.

  • This Section does not limit either party’s right to seek injunctive relief for IP misuse or unauthorized disclosure of confidential information.

Governing Law; Venue

This Agreement is governed by the laws of the State of Connecticut, without regard to conflict-of-laws principles. Subject to Section 15 (arbitration), the exclusive venue for any permitted court action is the state or federal courts located in New London County, Connecticut, and you consent to personal jurisdiction there.

Severability; Assignment; Survival; No Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign your rights without our consent; we may assign to an affiliate or successor. Sections that by their nature should survive (including, without limitation, payment obligations, IP, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution) survive termination. Our failure to enforce any right is not a waiver.

Email & SMS Communications:

By providing your email address and/or mobile phone number through our website, checkout, or sign-up forms, you consent to receive transactional, service-related, and promotional communications from KreativeByDesign, DBA Kreative Kreationz, including order confirmations, shipping updates, promotions, special offers, cart reminders, and restock notifications.

Email Communications. You may unsubscribe from marketing emails at any time by using the unsubscribe link included in our emails. Transactional or service-related emails (such as order or account notifications) may still be sent as required to complete your purchase or respond to inquiries.

SMS/Text Messaging. By opting in to receive SMS/text messages, you consent to receive recurring automated promotional and personalized marketing messages from KreativeByDesign, DBA Kreative Kreationz at the mobile number provided. Message frequency varies. Message and data rates may apply. Consent to receive SMS marketing messages is not a condition of purchase. You may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact us using the contact information on our website. You may receive one final confirmation message after opting out.

We are not responsible for delayed or undelivered messages. You are responsible for providing accurate contact information and for updating it if your email address or mobile phone number changes. We reserve the right to modify or terminate our email or SMS communications programs at any time in accordance with applicable laws.

Changes to the Terms

We may update these Terms at any time by posting the revised version with the effective date above. Your continued use after changes are posted constitutes acceptance.
